Frequently Asked Questions (FAQs)

1. What is a bail bond?

A bail bond is a financial guarantee provided by a bail bond company to the court, ensuring the defendant appears for all required court dates. This allows the defendant to be released from custody while awaiting trial.

2. How does the bail bond process work?

  • Contact a bail bond company and provide necessary details about the defendant.

  • Pay a non-refundable premium, typically 10-20% of the total bond amount. Additional escrow may be required, ranging from a percentage to the full bond amount.

  • The bail bond company posts the bond to secure the defendant’s release.

  • The defendant must comply with all court requirements and bond conditions.

3. Who can cosign for a bail bond?

A cosigner is usually a friend or family member who agrees to take financial responsibility for the bond.

Proof of identity, employment, and financial stability is required.

4. What happens if the defendant fails to appear in court?

If the defendant misses a court date:

  • The bail bond company may have to pay the full bond amount.

  • The cosigner is responsible for reimbursing the company.

  • If on a payment plan, the cosigner must pay the remaining balance and any costs for recapturing the defendant.

  • A warrant may be issued for the defendant’s arrest.

5. Can I get my bail money back?

The premium (10-20% of the bond amount) is non-refundable. However, escrow or collateral provided will be returned once the case is resolved, and bond conditions are met.

Violations of bond conditions or the need to recapture the defendant may result in the forfeiture of escrow or collateral.

6. How long does the bail bond process take?

Typically, the release process takes a few hours, depending on the jail's processing time. Delays beyond this are due to internal jail issues.

The Sheriff's Office advises allowing up to four hours. Bail & Rescue will follow up with the Sheriff's Office if the release exceeds four hours.

7. Can a defendant leave the state while out on bond?

Travel restrictions vary based on court orders. If GPS monitoring is required, additional conditions may apply.

Always confirm with the bail bond company, GPS monitoring provider, and the court before traveling, especially out of state.

8. What if I can’t afford the bond?

For bonds over $25,000, we offer payment plans with these terms:

  • Down payment of 50-70% of the bond amount, based on the bond’s value.

  • Remaining balance must be paid within 12 months.

  • Monthly payments are capped at $850 to ensure affordability.

Eligibility Criteria for Payment Plans

  1. Stable Income: Proof of income (e.g., pay stubs or bank statements).

  2. Employment Verification: At least three months of employment or consistent history.

  3. Residency: Proof of stable housing (e.g., lease, mortgage, or utility bill).

  4. Co-Signers: May require co-signers meeting the same criteria.

  5. Collateral: Property or vehicles may be required for higher bond amounts.

Flexible Payment Plan Features

  • Custom Installments: Weekly, bi-weekly, or monthly payment options.

  • No Prepayment Penalties: Pay off early without additional fees.

  • Clear Terms: Transparent agreements on payments and balances.

  • Collateral Options: Property, vehicles, or other assets can secure the bond if needed.

9. Can a bail bond be revoked?

Yes, a bail bond can be revoked if the defendant violates bond conditions, misses court dates, or engages in illegal activities.

10. What is collateral, and why is it needed?

Collateral is an asset (e.g., property, vehicle, or jewelry) used to secure the bond.

It ensures the bail bond company is protected if the defendant fails to comply with bond obligations.

11. Can a non-U.S. citizen get a bail bond?

Yes, non-U.S. citizens can obtain a bail bond but may need additional documentation, such as a passport, visa, or ITIN. Collateral may also be required.

12. What happens if the charges are dropped?

If the charges are dropped and the bond is exonerated, the cosigner remains responsible for paying any outstanding balance on the bond.

The exoneration releases the bail bond company from further obligations to the court but does not eliminate the cosigner’s financial commitment.

While the premium is non-refundable, any escrow or collateral provided will only be returned once the case is resolved and all financial obligations, including the remaining balance, have been fully satisfied.

13. How do I find out if my loved one is in jail?

Bail & Rescue Bonding exclusively provides inmate locator services for Davidson County (Nashville, TN) and can only assist with locating individuals held within this county.

14. Do bail bond companies operate 24/7?

Yes, most bail bond companies, including Bail & Rescue Bonding, are available 24/7 for emergencies.

15. What information do I need to get started?

  • Defendant’s full name and date of birth.

  • Facility or county where the defendant is being held.

  • Bond amount and cosigner’s information.

16. What is escrow in a bail bond?

Escrow is a financial arrangement where a percentage or the full bond amount is set aside as collateral to secure the bond. It protects the company in case of bond violations.

17. Will I get my escrow back?

Yes, escrow is refunded once the case is resolved. The cosigner must contact the company, complete an Escrow Refund Release Form, and provide ID. Refunds are processed within 10 business days after verification.

18. Intake Questionnaire

All cosigners and defendants must complete an intake questionnaire, including:

  • Defendant’s name, residence, and employment details.

  • History of arrests, warrants, or missed court appearances.

  • Cosigner’s relationship to the defendant and financial information.

19.  Your 4th & 5th Amendment RIGHTS!

Fourth Amendment:
You have the right to privacy and protection from unreasonable searches and seizures.

This means law enforcement can’t search you, your home, or your belongings without a good reason (probable cause) and, in most cases, a warrant that clearly states what they’re looking for and where.

Fifth Amendment:
You have several important protections, including:

  • You can’t be forced to testify against yourself (the right to remain silent).

  • You can’t be tried twice for the same crime (no double jeopardy).

  • You have the right to due process, meaning the government must follow fair procedures before taking away your life, liberty, or property.

  • If the government takes your property for public use, they must compensate you fairly.
